    Webinar – Revised Overtime-Exempt Regulation Update

    In February, Department of Labor Secretary Perez said in a Bloomberg interview that he was confident the final regulation of the overtime-exemption rule would be out by spring 2016.  The rule was announced on Monday, March 14. The next step will be publication in the Federal Register and the rule will more than likely go into place sometime this summer.

    Here’s what will probably be in the final regulation:  

    • The current salary threshold for an exempt employee could be raised from $23,660 to $50,500.  The DOL proposes that the threshold will be adjusted on an annual basis.
    • DOL proposed that in meeting the salary threshold, employers could use non-discretionary bonuses.  DOL proposed that 10% of an employee’s salary would be allowed for non-discretionary bonuses.  Union and employee-advocacy groups were against the bonus/salary threshold concept and, of course, employers and employers supported using the bonus. 
    • No changes in the “duties tests” were proposed but DOL sought comments on if changes should be made.  Kyger thinks a change is very possible, but if done, would be subject to various legal-challenges because DOL did not follow proper protocol in the rule-making process.
